Our services

Our Center provides a wide range of administrative and support services to facilitate mediation processes, including the Mandatory Initial Mediation Session as described in Law 4640/2019, ensuring adequate, effective and high quality services.

Especially, our Center:

  • Provides a List of Trained Financial Mediators from which the parties can select one for their case.
  • Acknowledges the availability of the selected mediator.
  • Communicates with the parties to determine whether they agree to proceed and to ensure that they accept the selected mediator is acceptable.
  • Provides appropriate and adequately equipped rooms to hold mediation sessions (both joint and caucus sessions) and preparatory sessions as well as rooms for coffee breaks, snacks and light lunches.
  • Coordinates, in consultation with the mediator and the parties, mutually convenient dates, mediation scheduling and other necessary details to ensure the smooth operation of the process.

 

The Center delivers its services in accordance with the fundamental principles of mediation, like impartiality, confidentiality, neutrality and self-determination by the parties. The mediation process is conducted by the selected mediator (as described by law), while the Center provides all necessary administrative and support services to facilitate the mediation processes.

 
Disputes we can deal with

The Center provides administrative and support services to facilitate mediation processes in the financial service sector:

  • Disputes arising under, out of or in connection with a loan agreement or other contracts between a borrower and a credit institution or a credit & debt management company (operating under L. 4354/2015).
  • Disputes arising out of or relating to brokerage and investment advisory services.
  • Disputes arising under insurance or reinsurance contracts (civil liability insurances, life and non-life insurances).
  • Disputes arising under any other financial services provision, like leasing, factoring, forfaiting , trade finance etc.
  • Any other commercial dispute between natural persons or/and legal entities.

 

Mediation

If you wish to use our services, please follow the steps described below:

Step 1: Submit an Application Form  

  • Fill in the application form and send it to the Center (email: fin–adr@hobis.gr, fax: 0030 210 3238821, postal address: 1, Massalias street, 106 80, Athens, Greece).
  • When the Center receives your application form:
    • Communicates with the other party in order to determine whether it agrees to proceed.
    • Provides a List of Trained Financial Mediators from which the parties can select one for their case.
    • Acknowledges the availability of the selected mediator

Step 2: Mediation Sessions

The mediation session is conducted between the parties and their lawyers. Parties may also ask certain experts to attend (e.g. accountants, financial experts).

The Center provides appropriate and adequately equipped rooms to hold mediation sessions (both joint and caucus sessions) and  preparatory sessions as well as rooms for coffee breaks, snacks and light lunches, and coordinates, in consultation with the mediator and the parties, mutually convenient dates, mediation scheduling and other necessary details to ensure the smooth operation of the process.

Step 3: Conclusion of the Mediation Process

  • If parties reach an agreement, a Mediation Settlement Agreement is signed by the mediator, the parties and their lawyers. If parties fail to reach a settlement. A Failure Report is signed.
  • The Center may ask the parties to fill in an evaluation form, in order to get valuable feedback to improve service provision

 

Mandatory Initial Mediation Session

  • To initiate a Mandatory Initial Mediation Session please fill in the respective application form and send it to the Center (email: fin–adr@hobis.gr, fax: 0030 210 3238821, postal address: 1, Massalias street, 106 80, Athens, Greece).
  • The Center will provide a List of Trained Financial Mediators from which the party can select one for its case.
  • The Center will acknowledge the availability of the selected mediator.
  • The mediator will contact the other party asking to participate in the Mandatory Initial Mediation Session.
  • The Center coordinates, in consultation with the mediator and the parties, mutually convenient dates, mediation scheduling and other necessary details to ensure the smooth operation of the process.

 

Pricing

  • Mandatory Initial Mediation Session: €20 + VAT 24% (each party)
  • Mediation Session: €90 + VAT 24% (each party)

 

Mediator may freely agree upon his/her remuneration with the parties (without involvement of the Center).
